General

The purpose of this document is to establish the conditions applicable to the sale of products through the www.musicaencolores.com website (hereinafter "the Website").

Placing Orders

Orders are placed directly through the procedure set up for this purpose on the Website, accepting these terms and conditions of use.
The Client will be solely and exclusively responsible for the veracity and accuracy of the information provided for the delivery and/or dispatch of their orders.

Pricing & Payments

The price and characteristics of each product will be those published on the Website at the time the Customer makes the purchase, and Música en Colores® reserves the right to modify these elements at any time.

The prices published on the Website must be understood to include VAT.

Once the payment has been made and accepted by the relevant financial institution, Música en Colores® will be able to complete the order. Otherwise, the order will remain pending payment, and if it is not completed within 5 business days, the order will be cancelled.

Deliveries

By purchasing on the Música en Colores® website, the customer may choose to pick up their order at our store or office, or a shipment to be paid to the address or branch indicated on the purchase form.

For in-store or in-office pickup, the Customer will be notified via email that their order is now available for pickup, within a maximum period of 10 business days from the correct receipt of payment. The customer will have 30 calendar days to withdraw their purchase. If you fail to do so, a second notice will be sent to you. If after 10 business days after the second notice the Customer has not withdrawn their order, the purchase will be declared obsolete.

For shipments, Música en Colores® will have a maximum of 7 business days to deliver the package with the Customer's products to the requested transport company.

The Customer may reserve products that are out of stock momentarily by calling our telephone numbers or writing an email to ventas.musicaencolores@gmail.com, and paying the corresponding amount for the product via bank transfer. Delivery times in this case will run from the arrival of the requested stock.
Música en Colores® is not responsible for unforeseen events that may occur to its suppliers causing delays in the replenishment of stock.

Offices

Música en Colores® makes payable shipments through Starken or Correos Chile. The values of the products indicated on the Website do not include shipping values.

The cost of each shipment depends exclusively on the transport company, having a relationship with the destination commune and the weight of the product, from our nearest branch in the commune of Las Condes in the Metropolitan Region.

The Customer can quote the approximate shipping value directly on the Starken or Correos Chile website, with the data provided by Música en Colores® in the "Shipping costs" section of the Website. The Client is aware of and responsible for the approximate value of the delivery that he/she is requesting to be made from Música en Colores®, and is solely responsible for the payment for that service to the transport company.

It is the Customer's responsibility to enter real, complete and accurate information so that their order is dispatched without inconvenience. Música en Colores® is released from any liability arising from false or erroneous data.

If the Customer requested delivery to be paid at home, he/she is aware that a person of legal age (+18) must be found at the home or at the concierge on the day or time that the transport company indicates that it will make the delivery. This person must have the amount to pay the delivery person the value of the service according to the protocols and forms of the transport company.

If the Client requested dispatch with pick-up at a Starken or Correos Chile branch, he/she is aware that each transport company has its own deadlines and conditions for the Client to pick up his/her parcel. If the Customer does not pick up their order within the period established by the shipping company, they must be responsible for the associated charges that the shipping company may generate for the withdrawal or re-shipment of their order.

Errors in dispatch information

If the Client has made a mistake in the delivery address, they must contact Música en Colores® at any of our telephone numbers or by ventas.musicaencolores@gmail.com email to manage the change or modification of the data. This will be possible only if the order has not yet been delivered to the transport company, so it is very important that the Customer verifies that all the data is correct before validating the purchase, or communicates immediately after identifying an error. If the package is already in the possession of the shipping company, the Customer must contact the carrier directly, with the tracking number that Music in Colors® will provide, to request the corresponding modifications.

Order Tracking

Música en Colores® will provide the Customer by email with the tracking information provided by the transport company for the tracking of the order, as well as the exact amount to be paid for home or branch delivery, and the estimated delivery date. From that moment on, the follow-up and receipt of the order is the sole responsibility of the Client.

Returns & Exchanges

If the Customer's purchase is damaged or defective, he/she will have 5 business days from receipt of the order to request an exchange for the same product, another of the same value, or a refund of the full cost of the product.

For both cases, you must call our office at 2(2)2797972 or write to ventas.musicencolores@gmail.com. The Customer will be asked to send photographs or videos of the defect of the product.

This warranty does not apply in the following cases: misuse or improper use of the purchased product, deterioration caused by normal use and/or the passage of time, damage or failure that is the result of fortuitous event or force majeure (such as fire, theft, earthquake, tidal wave, lightning, floods, overflows), or damage caused while the product was in the possession of the transport company.

To comply with this right, the products must be returned to Música en Colores®, where once received, the product will be exchanged or the money will be returned within a period of up to 10 business days.

Request for cancellation of purchases and money-back deadlines

You will only be able to request the cancellation of your purchase before your order is in the possession of the transport company, since being an external one, Música en Colores® will not be able to stop it. Cancellation requests will be dealt with in our office by telephone at 2(2)2797972 and will be made immediately. After that, the refund will be processed, which will be in no more than 5 business days.

Despite the efforts we make, some of the products you bought may suffer a stock-out at some point.

If that happens, we will contact you to discuss the situation and give you a replacement date for the material.

Product Changes

If the Customer made a mistake in the purchase of any of their products purchased on the Website, they can request the change by calling our office at 2(2)2797972. The change can only be made before the order is in the possession of the transport company, since being an external one, Música en Colores® will not be able to stop it.

If so, the Customer may exchange their product for another of the same price, pay the difference if they need a product with a higher price, or request a refund of the difference if the product they need is of a lower price. Both Music in Colors® and the Customer will have 5 business days to pay the difference.

In the event that the Customer requests an exchange at the time that his/her order is no longer in the possession of Música en Colores®, it will be the Client's total responsibility to return the product purchased in perfect condition to Música en Colores® and pay the shipping costs that may be associated with the transfer of the material back to the Música en Colores® facilities. and then back to your address.

Privacy Policy

To make the purchase, the Customer will be asked for their consent by reading and accepting these Terms and Conditions, choosing the option "I HAVE READ AND EXPRESSLY ACCEPT THE TERMS AND CONDITIONS OF MÚSICA EN COLORES".

The use of the Website by the Client constitutes the acceptance of these Terms and Conditions, which may be updated or modified from time to time without prior notice to the user.

The data entered by the Client at the time of validating a purchase will be treated confidentially and will be used by Música en Colores® exclusively to process the purchase, the dispatch and, if applicable, the sending of information about the method, training for teachers, events or others.

By accepting these policies, the Client expressly authorises his/her data to be communicated to third parties only for the purpose of deliveries or dispatches of his/her purchase.

The Client understands and accepts that the security measures on devices and systems connected to the internet are not impregnable and that, by their nature, they are exposed to violations that are not under the control of Música en Colores®. In this sense, Música en Colores® is not responsible for any damage, loss or loss
suffered by the Client caused by system, server or internet failures, or the introduction of any virus that could cause damage to the user's equipment.

Intellectual property

All the contents of the Website, including its design, texts, literary works, graphics, photographs, trademarks and trade names, images, sounds, videos and distinctive signs, among others, are the property of Música en Colores®.

The reproduction, modification, adaptation, translation or distribution of the contents in any of its forms could be considered a crime according to current legislation, unless there is an express written authorization from Música en Colores®.
